This paper presents a critical and analytical view of Article 1068 of the Commercial Code, amended by Act 45 of 1990, which governs the late payment of premiums in the insurance contract. In this article, the author analyzes the figure from the perspective of the comparative law and the jurisprudence in the subject.
Este artículo muestra una visión crítica y analítica del artículo 1068 del código de comercio, modificado por la ley 45 de 1990, que regula la mora en el pago de la prima en el contrato de seguro. En éste, el autor analiza la figura a luz del derecho comparado y de algunos pronunciamientos jurisprudenciales que se han producido en la materia.
