نبذة مختصرة  : Does the so-called constitutional principle of laïcité apply to cemeteries when they are included in the “public domain” and to most funeral rites, particularly those included in the “public service” – neutral and “external” – of funerals? Since the law of 9 December 1905, the answer should be in the affirmative. However, it is clear – to varying degrees – that between religious freedoms and laïcité, the former prevail (by law, case law or by administrative tolerances).
