O presente estudo, versando sobre a humanização da Justiça Militar ao tempo da Regeneração, trata, de forma pioneira, duas factualidades que se encontram conexas. Primo, expõe e reflete sobre as motivações que determinaram a abolição das penas corporais no exército. Secundo, debruçando-se sobre a exigente conciliação entre disciplina militar e garantias constitucionais, percorre, analiticamente, todo o processo de elaboração, aprovação e vigência do Regulamento Provisório disciplinar do exército em tempo de Paz (1856). ; This article addresses the issue of humanizing the Military Justice during the “Regeneração” period and pioneers the study of two related facts. Firstly, it outlines and reflects on the reasons which determined the abolishment of corporal punishment in the army. secondly, it examines the difficult conciliation between military discipline and constitutional safeguards, and analyses the whole process of elaboration, approval and term of the armys’s Provisional disciplinary Regulation in the Peacetime (1856). ; info:eu-repo/semantics/publishedVersion
