La casación en el orden contencioso-administrativo

Este TFG analiza la reforma del recurso de casación contencioso-administrativo que, llevada a cabo en el año 2015 a través de una mera Disposición Final, ha transformado radicalmente su anterior configuración. Frente al sistema anterior, el recurso gira ahora entorno a la concurrencia de interés casacional objetivo para la formación de la jurisprudencia de manera que solo accederán a la casación quienes al ejercitar sus pretensiones faciliten la labor nomofiláctica y uniformadora de la jurisprudencia (ius constitutionis). Ello supone que desde la perspectiva del derecho al recurso (ius litigatoris) la actual regulación supone una auténtica limitación respecto de la anterior y centra el debate que ha generado esta reforma entre el interés casacional y el principio de tutela judicial efectiva. ; This TFG analyzes the reform of the contentious-administrative cassation appeal which, carried out in 2015 through a mere Final Provision, has radically transformed its previous configuration. In contrast to the previous system, the appeal now revolves around the concurrence of an objective interest in the formation of jurisprudence so that only those who, by exercising their claims, facilitate the nomophylactic and standardizing work of jurisprudence (ius constitutionis) will have access to cassation. This means that from the perspective of the right to appeal (ius litigatoris) the current regulation represents a real limitation with respect to the previous one and focuses the debate that this reform has generated between the interest of cassation and the principle of effective judicial protection. ; Departamento de Derecho Público ; Grado en Derecho
