في ظل المتغيرات العالمية الأخيرة، أصبح التدخل الإنساني إحدى الآليات القانونية التي اعتمدها المجتمع الدولي لحماية حقوق الإنسان وحرياته الأساسية من جميع أشكال التهديد بالقوة والعدوان ويتماشى ذلك مع تدويل هذه الحقوق وتعزيز وسائل حمايتها في الاتفاقيات الدولية، ويشكل هذا المبدأ استثناء من المبدأ العام للقانون الدولي، الذي ينص على عدم التدخل في الشؤون الداخلية للدول واحترام سيادتها الداخلية، ويشكل مبدأ عدم التدخل والسيادة أهم المبادئ والأسس التي تقوم عليها العلاقات الدولية المعاصرة، وقد أصبح مفهوم التدخل الدولي الإنساني من أكثر القضايا اشكالا، ويثير جدلاً واسعاً على الساحة الدولية المعاصرة، نظراً لما يثيره من إشكاليات قانونية وتناقضات فيما يتعلق بمبدأ عدم التدخل والسيادة، فهو من جوانبه يشكل اعتداء على هذين المبدأين المنصوص عليهما في الاتفاقيات الدولية من جهة، ويمثل من جهة أخرى حماية لحقوق الإنسان من التهديدات القسرية والانتهاكات الجسيمة التي قد تتستر وراء مفهوم السيادة ومبدأ عدم التدخل في شؤونها. In light of recent global changes, humanitarian intervention has become one of the legal mechanisms adopted by the international community to protect human rights and fundamental freedoms from all forms of threat of force and aggression. This is consistent with the internationalization of these rights and the strengthening of means of protecting them in international agreements. This principle constitutes an exception to the general principle of international law, which stipulates non-interference in the internal affairs of states and respect for their internal sovereignty. The principles of non-interference and sovereignty constitute the most important principles and foundations upon which contemporary international relations are based. The concept of international humanitarian intervention has become one of the most problematic issues and arouses widespread controversy in the contemporary international arena, given the legal problems and contradictions it raises regarding the principles of non-interference and sovereignty. On the one hand, it constitutes an attack on these two principles enshrined in international agreements, while on the other hand, it represents the protection of human rights from coercive threats and gross violations that may be hidden behind the concept of sovereignty and the principle of non-interference in their affairs.
