Éléments constitutifs et combinatoires institutionnelles

Pour mieux comprendre le caractère inéluctable ou imprévisible de deux des trois évolutions majeures de la Cinquième République, « majoritarisation », présiden-tialisation, constitutionnalisation (celle-ci étant laissée à l'écart), la démarche adoptée, issue de l'analyse stratégique des institutions, établit, dans un premier temps, en fonction du degré de contrainte qu'ils font peser sur les acteurs, les éléments constitutifs de la Constitution de la Cinquième République, entendue au sens le plus large : scrutin majoritaire à deux tours, dissolution, élection présidentielle au suffrage universel direct, et, à un moindre degré, référendum, motion de censure. Better to understand the character, whether inevitable or unforeseeable, of two of the three major evolutions of the Fifth Republic - to a majoritarian and a presidential System, and to a constitutional one (here left out) - the method adopted, derived from strategie analysis of institutions, first identifies, depending on the degree of constraint which they bring to bear on the actors, thé components of the Fifth Republic's Constitution, broadly understood : majority two-round electoral System, right of dissolution, presidential election by direct universal suffrage, and, to a lesser degree, referendum and vote of censure. The potential logics are then described. The third step, inspired by multivariate analysis, consists of a study of thé combined effects of these five variables taken two by two and shows the complex theoretical combinatories. Finally, an examination of their joint impact reveals their cumulative constraint effect in the case of the Fifth Republic. This original combinatory of an election of the chief executive by universal suffrage, of a majority legislative vote and of the right of dissolution exercises maximum constraint and has no equivalent in the institutional history of pluralist democracies. Was it inevitable or unforeseeable ? The answer seems doser to the first alternative than to the second.
