      Esta contribución analiza las implicaciones de la sentencia del Tribunal de Justicia en el asunto Louboutin respecto de la responsabilidad de las plataformas de venta en línea por infracción de marca en relación con la comercialización por terceros de productos a través de la plataforma. Se considera en qué medida la nueva sentencia representa un progreso con respecto a la jurisprudencia previa del Tribunal de Justicia relativa a la responsabilidad de las plataformas en relación con contenidos difundidos por sus usuarios, así como su significado en relación con el Reglamento (UE) 2022/2065 de Servicios Digitales.
      This contribution analyses the implications of the judgment of the Court of Justice in Louboutin with regard to the liability of online marketplaces for trademark infringement in relation to the marketing of goods by third parties through the platform. The significance of the judgment is discussed in the context of the previous caselaw of the Court. Furthermore, the implications in this area of the new Digital Services Act are also considered.
