Análisis y Valoración del Trastorno Mental Tipo Penal Prescrito en la Legislación Ecuatoriana

The objective of this investigation is to analyze the crime typified in article 36 of the COIP on people with mental disorders in Ecuadorian legislation, in order to learn about the importance of the expert medical report carried out by specialists with expertise in psychiatry and psychologists who are In the evaluation of subjects involved in criminal proceedings, they carry out expert reports that will serve to advise Judges or Courts, establishing circumstances that could modify responsibility for the crime. In this sense, the importance of the expert contributing theoretically and practically with his knowledge to clarify problems in which his specialized capacity is needed and that can lead the judge to more accurate reasoning about the fact to be assessed is emphasized. For the case under study it would be when the person with a mental disorder is not liable for liability. The research is carried out under a qualitative paradigm, with a descriptive model of a bibliographic review type, with a methodological strategy based on the general methods of scientific research: hermeneutic, documentary review and analytical-synthetic, as a technique the review of texts and other documents, to conceptualize the category under study and to be able to issue the discussion of results. Methods that made it possible to compare and summarize the documentary and bibliographic materials specialized in the topic.
La presente investigación tiene como objetivo analizar el delito tipificado en el art.36 del COIP sobre las personas con trastornos mentales en la legislación ecuatoriana, a fin de conocer sobre la importancia del informe médico pericial realizado por especialistas con experticia en psiquiatría y psicólogos que se desenvuelven en la evaluación de sujetos implicados en procesos penales, informes periciales que servirán para asesorar a Jueces o Tribunales, estableciendo circunstancias que podrían modificar la responsabilidad ante el delito. En este sentido se enfatiza sobre la importancia de que el perito de manera teórica y práctica aporte con sus conocimientos para aclarar problemas en los cuales se necesita de su capacidad especializada y que pueden llevar al juez a un razonamiento más acertado sobre el hecho a valorar, para el caso objeto de estudio sería cuando se da la inimputabilidad de la persona con trastorno mental. La investigación se realiza bajo un paradigma cualitativo, con un modelo descriptivo de tipo revisión bibliográfica, con una estrategia metodológica fundamentada en los métodos generales de investigación científica: hermenéutico, revisión documental y analítico-sintético, como técnica se recurrió a la revisión de textos y otros documentos, para conceptualizar la categoría objeto de estudio y poder emitir la discusión de resultados. Métodos que permitieron cotejar y resumir los materiales documentales y bibliográficos especializados en el tema.
