A discriminação estrutural, o trabalho escravo e a questão de gênero nas relações trabalhistas dos casos Fazenda Brasil Verde e empregados da fábrica de fogos de Santo Antônio de Jesus: uma análise destas condenações do Brasil pela Corte Interamericana de Direitos Humanos

This study listed similarities and differences that underlie the context of labor relations in two cases in which Brazil was condemned by the Inter-American Court of Human Rights: Fazenda Brasil Verde and Employees of the Santo Antônio Fireworks Factory. It analyzed the aspects in which the sentences pronounced generated effective actions by the State, with the discussion topics being structural discrimination, slave labor, and gender issues. The methodology applied was documental and bibliographical analysis through exploratory research carried out between February 2022 and December of the same year. It concludes that there is a lack of celerity in the full compliance of the sentences by Brazil and that the cases have important indications of the country's omission in relation to topics that harm human dignity, despite directing efforts to remedy the issues presented by the submitted international court.
Este estudo elencou similaridades e diferenças que sustentam o contexto das relações trabalhistas de dois casos em que o Brasil foi condenado pela Corte Interamericana de Direitos Humanos: Fazenda Brasil Verde e Empregados da Fábrica de Fogos de Santo Antônio. Analisou em que aspectos as sentenças proferidas geraram ações efetivas do Estado, sendo os temas de discussão: discriminação estrutural, trabalho escravo e a questão de gênero. A metodologia aplicada foi análise documental e bibliográfica por meio de uma pesquisa exploratória realizada entre fevereiro de 2022 e dezembro do mesmo ano. Conclui-se que há falta de celeridade no cumprimento integral das sentenças pelo Brasil e que os casos possuem importantes indicativos da omissão do país em relação a temas que ferem a dignidade humana, apesar de direcionar esforços para sanar matérias apresentadas pelo tribunal internacional submetido.
