This article recreates from a historical perspective the constructive evolution of the general principles of Law in the Cuban legal ideology prior to 1959. For a thorough understanding of the subject under analysis, the discourse is constructed from a philosophical approach around the problematic between the naturalist and positivist positions about the Law and its influence on the mainstream phenomenon. In order to provide exhaustive notes, three major courses of interpretation of the general principles of Law in the prerevolutionary Cuban reality are assumed: doctrinal, legislative and jurisprudential.
El presente artículo recrea desde una perspectiva histórica la evolución constructiva de los principios generales del Derecho en el ideario jurídico cubano anterior a 1959. Para una cabal comprensión del asunto sometido a análisis, el discurso se construye desde un enfoque iusfilosófico en derredor de la problemática entre las posturas naturalistas y positivistas en torno al Derecho y su influjo en el fenómeno principalista. A fin de brindar notas de exhaustividad se asumen tres grandes derroteros de plasmación de los principios generales del Derecho en la realidad cubana prerrevolucionaria: el doctrinal, el legislativo y el jurisprudencial.
Cet article retrace historiquement l’évolution constructive des principes généraux du droit dans l’idéologie juridique cubaine avant 1959. Pour une compréhension approfondie du sujet analysé, le discours est construit à partir d’une approche iusphilosophique de la problématique existente entre les positions naturaliste et positiviste autour de la loi et leur influence sur le phénomène principal. Afin de fournir une analyse exhaustive, trois grands courants d’expression des principes généraux du droit dans la réalité pré-révolutionnaire cubaine sont assumés: la doctrine, la législation et la jurisprudence.
