TERRITORIAL JURISDICTION IN DISPUTES ARISING FROM LEASE RELATIONS OVER SHIPS

Pojam zakupnih odnosa na brodu podrazumijeva uz odnose vezane uz uporabu broda i druge odnose koji nastaju iz takvog ugovora, uključujući i novčane obveze ugovornih strana. Spor o vraćanju akontacije iz ugovora o zakupu broda je spor iz zakupnih odnosa te je za suđenje u tom sporu isključivo mjesno nadležan sud na čijem se području vodi upisnik u kojem je brod upisan. Odredbe o isključivoj mjesnoj nadležnosti eliminiraju opću i svaku drugu mjesnu nadležnost osim one izričito propisane zakonom, pa se primjena pravila o isključivoj mjesnoj nadležnosti ne može otkloniti niti ugovaranjem mjesne nadležnosti. Zbog isključive mjesne nadležnosti stranke ne mogu postići sporazum da im sudi neki drugi stvarno nadležan sud.
When a court in the Republic of Croatia has jurisdiction in disputes arising from lease relations over ships, territorial jurisdiction shall exclusively lie with the court on whose territory the registry in which the ship is registered is kept.
