Pergulatan Internasionalisasi Konsep Hak Asasi Manusia Proses Globalisasi dan Implikasinya Terhadap Penegakan Hukum di Indonesia: Menciptakan Konsep Hak Asasi Manusia Elusif?

This article discusses the elusive concept of Human Rights that is currently developing, this can be seen from the anarchist actions that often occur in actions in the name of Human Rights. The problem discussed is why the constitutional substance of law and human rights is said to be elusive, and how to categorize an action that brings out the elusive side of human rights. By using a normative juridical approach and secondary materials from various existing literature, it is hoped that this study will be able to find bright spots in Indonesia's social climate. There are many causes that influence the elusiveness of the substance of the constitution and human rights, the most striking of which is in terms of law enforcers whose performance is influenced by structural, substance and cultural systems, excessive sentiment in violating the law, socio-cultural products that are at odds with the nation's ideology, blid social behavior due to socio-political issues and weak understanding of human rights and the substance of the constitution.
