نبذة مختصرة : The present investigation deals with the similarities and differences existing between the ordinary prescription and extraordinary acquisitive of domain in the Ecuadorian legislation, in this way to study each one of these institutions of Law, as well as to know about their procedures, the requirements that are necessary to be able to request before the judge the concession of the property by the possessor in good faith. The acquisitive prescription of ownership is a way of acquiring the things of others by the fact of having possessed them; this for a certain time that is required for each case; with the spirit of lord and owner; that the thing is within human commerce, that is, that it is susceptible to alienation; that the action be exercised against the true owner of the property that is intended to be prescribed; the goods that are intended to be prescribed will be individualized, singled out and identified. This instruction of the Law seeks that things comply with their function, assuming that the owner has carefree of the same, in this sense the owner to meet the requirements to operate this kind of prescription will go to the judge to be declared or recognize as owner. The owner for a long time has been in possession of real estate or furniture as appropriate, having a very close relationship with the thing and in a way maintaining the quality of mere owner; the legislation recognizes this possessor as a person who seeks that things comply with their purpose, to exemplify that a house is inhabited. ; La presente investigación trata acerca de las semejanzas y diferencias existentes entre la prescripción ordinaria y extraordinaria adquisitiva de dominio en la legislación Ecuatoriana, de esta manera estudia cada una de estas instituciones del Derecho, así como también acerca de sus procedimientos y los requisitos necesarios para poder solicitar ante el juez la concesión de la propiedad por parte del poseedor de buena fe.
