نبذة مختصرة : In Article 54 of Law Number 30 of 2004 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notaries, the Notary has the obligation to provide a copy of the deed to the debtor as an interested party. However, in general, notary and bank officials often do not provide a copy of the deed to the debtor, as happened in the case that is the object of this research.This research uses a normative juridical method by analyzing secondary data in the form of statutory regulations and legal research, as well as various literature such as books and journal articles that are relevant to this research.The result of this research is that the legal consequence of a deed that has been made or will be made by a notary official who is subject to administrative sanctions is that the deed will temporarily be transferred and held by the notary protocol holder. The legal considerations of the Palu High Court judges in Decision Number 03/Pdt/2013/PT.Palu and the Panel of Supreme Court Judges in Decision Number 2756K/Pdt/2013 are not in accordance with the legal objectives of providing justice, legal certainty and benefit.
