نبذة مختصرة : Violence against women is a practice that dates back many years and, over time, crimes of a sexual nature have become even more rooted in international conflicts, highlighting the vulnerability of women who suffer sexual aggression. Through bibliographic research, this article proposes to study how the International Criminal Court incorporated the crimes of sexual violence in its regulations, being one of the greatest international advances regarding the protection of the rights of the human person. In this context, its creation was aimed at judging and punishing crimes against humanity. In this context, the present work proposes to articulate about the gender perspective in relation to sexual violence in armed conflicts. In addition, questioning the historical context on the aspects of machismo, the imposition and causes of this violence, as well as the criminal classification of the protections covered by the Rome Statute in the context of violence against women in armed conflicts, incorporating their protection to Humanitarian Law. ; A violência contra a mulher é uma prática que remonta a muitos anos e, com o passar do tempo os crimes de natureza sexual foram se enraizando ainda mais em conflitos internacionais, evidenciando a condição de vulnerabilidade das mulheres que sofrem a agressão sexual. Por meio de pesquisa bibliográfica, este artigo propõe a estudar como o Tribunal Penal Internacional incorporou os crimes de violência sexual na sua normativa, sendo um dos maiores avanços internacionais no que tange à proteção dos direitos da pessoa humana. Nesse contexto, objetivou-se sua criação no intuito de julgar e punir os crimes contra a humanidade.
