Obras generadas por algoritmos : en torno a su posible protección jurídica

Sobre la base de los diferentes modelos de creatividad humana, se expone la posible emulación de ésta por parte de sistemas basados en inteligencia artificial. En determinados casos, el grado de originalidad de las creaciones mediante algoritmos puede sorprender hasta al propio individuo. En este ensayo, se plantea, por un lado, la protección de las «obras» creadas por un sistema autónomo, en el ámbito de los Derechos de autor, teniendo especialmente en cuenta las fundamentales aportaciones realizadas por los investigadores en Ciencias de la Computación y, por otro, la protección de la inversión en recursos humanos y económicos realizada para obtener tales «obras» proponiendo distintas vías legales en las que poder encajar a las obras generadas mediante algoritmos. ; The possible emulation of human creativity by artificial intelligence systems based on the various models of it is discussed. In some instances, the degree of originality of creations using algorithms may even surprise human beings themselves. In this work, the protection of the «works» created by an autonomous system is proposed in the field of Copyright, especially taking into account the fundamental contributions made by computer science researchers, on the one hand and, on the other, the protection of the investment in human and economic resources made to obtain these «works». Different legal frameworks are suggested in order to include algorithms generated works.
