من أهم القضايا المثيرة للمناقشة في الفقه والقانون هو تقييم ماهية الدية كطبيعة قانونية مقبولة في الإسلام و الذي لم تتخذ السلطة التشريعية ماهية واحدة للدية في فترات التشريعية المختلفة بسبب الخلافات بين الفقهاء و المحامين، و قد أدى ذلك إلى تخبط المحاكم. في المصادر الفقهية والقانونية، اعتبر البعض الدية نوعًا من العقاب. يرى البعض أنها نوع من جبران الخسارة المدنية، والبعض يرى للدية ماهية ثنائية. و في قانون العقوبات الإسلامي لإيران، الذي تم الموافقة عليها في عام 1392، فإن إتجاه السلطة التشريعة هو قبول الدية كطبيعة ذات ماهية ثنائية. ; One of the most important issues for discussion in jurisprudence and law is the evaluation of the nature of blood money as an acceptable legal nature in Islam, in which the legislative authority did not adopt a single nature for blood money in different legislative periods due to differences between jurists and lawyers, and this led to confusion in the courts. In jurisprudential and legal sources, some consider blood money as a form of punishment. Some see it as a kind of reparation for civil loss, and some see blood money as having a dual nature. In the Islamic Penal Code of Iran, which was approved in 1392, the direction of the legislature is to accept blood money as a dual nature.
