Conflicto objetivo de intereses en el arbitraje internacional El fenómeno del 'double-hatting'

This dissertation attempts to analyze the issue conflict in international arbitration, particularly the phenomenon of the “double-hatting”. Consequently, the standards of independence and impartiality applicable to the arbitration process will be discussed widely, and also the possible the solutions to this problem. Thus, this dissertation will focus on the creation of separated bars regarding attorneys and arbitrators. The overall conclusion is that a viable solution for international investment arbitration could be the implementation of separate bars for arbitrators and counsel. Whereas in international commercial arbitration, a viable solution would be the expedition of regulations that clearly address the existence of a conflict of interest and the measures to be implemented thereto. ; En esta tesina se analizará el conflicto objetivo de intereses en el arbitraje internacional, en especial el fenómeno del “double-hatting”. Para esto, se estudiarán los estándares de independencia e imparcialidad aplicables al arbitraje y cuáles son las posibles soluciones para este problema. Se prestará una mayor atención a la propuesta de crear diferentes barras para representantes de parte y para árbitros. La conclusión general deriva en que la separación de representante de parte y de árbitros en diferentes barras, es una solución viable en los arbitrajes de inversiones, mientras que para los arbitrajes comerciales la solución es la promulgación de normas que regulen de manera clara los casos de conflictos relacionados al “double-hatting”.
