O papel das decisões judiciais na teoria do estado pós democrático de direito e o fenômeno da judicialização

This search deals with the phenomenon of judicialization in the Post-Democratic State and its reflexes on the limits established through rights, bringing a reflection on the structure of justification of judicial decisions and the weaknesses of the state. In this sense, the attributions of powers and their effectiveness can be questioned, allowing another power to make decisions in favor of the State, and what are the conditioning structures for this phenomenon? The question brings the problematic genre, which from it arise several other points that highlight the relevance of the research. Among the research justifications, the theory of the post-democratic State of Law emerges, the weaknesses of this deconstruction to justify some of the decisions of the STF. Thus, the judicialization of rights, countermajoritarian, representative and enlightened judicial decisions and the limits of decisions in the post-democratic rule of law were addressed. We used the hypothetical deductive method, bibliographic research, in specialized magazines and periodicals and other references, in addition to a comparative analysis of the theories of Luís Roberto Barroso and Rubens Casara, using these two theoretical frameworks for the analysis. It is verified in the results achieved the influences on the judiciary and the breaking of the limits in favor of the neoliberal project that represents a setback of the democratic State and of Law. ; Este trabalho trata sobre o fenômeno da judicialização no Estado Pós-democrático e seus reflexos nos limites estabelecidos através de direitos, trazendo uma reflexão sobre a estrutura de justificação das decisões judiciais e as fragilidades do estado.
