O CONSTITUCIONALISMO, O NEOCONSTITUCIONALISMO E A CONVENÇÃO AMERICANA DE DIREITOS HUMANOS NA DURAÇÃO RAZOÁVEL DO PROCESSO DO DIREITO À SAÚDE BRASILEIRO ; CONSTITUTIONALISM, NEOCONSTITUTIONALISM AND THE AMERICAN CONVENTION ON HUMAN RIGHTS IN THE REASONABLE DURATION OF THE BRAZILIAN RIGHT TO HEALTH PROCESS

Esta pesquisa analisou o surgimento do constitucionalismo e seu desenvolvimento na civilização. A mudança de um Estado Legislativo de Direito para um Estado Social de Direito que originaria o neoconstitucionalismo e o fortalecimento das Constituições. Este estudo também trata do direito à saúde e a razoável duração do processo para sua concretização, amparada nos tratados internacionais, e como a Convenção Americana de Direitos Humanos contribuiu para o progresso do direito fundamental a saúde, estimulando o seu fornecimento em uma duração razoável e almejando a promoção de uma justiça social. ; This research analyzed the emergence of constitutionalism and its development in civilization. The change from a Legislative State of Law to a Social State of Law that would give rise to neoconstitutionalism and the strengthening of Constitutions. This study also deals with the right to health and the reasonable duration of the process for its realization, supported by international treaties, and how the American Convention on Human Rights contributed to the progress of the fundamental right to health, stimulating its provision within a reasonable and aiming to promote social justice.
