El delito de violación: Perspectiva penal, criminológica y penitenciaria. La reincidencia ; Sexual assault. Criminological and penitenciary perspective. Recidivism

En el presente trabajo se realiza un análisis del delito de agresión sexual desde tres perspectivas, para conocer todo lo relativo al mismo y realizar un estudio final. Por ello se hará, en primer lugar, un análisis acerca de la regulación penal del delito, sus variantes y todos los supuestos que podrían ocurrir; en segundo lugar, se pasará a analizar las partes en el presente delito: la víctima y el agresor sexual. En tercer lugar, se estudian los tratamientos que existen para este tipo de delincuentes y los que actualmente se encuentran ofertándose en España. Por último, también se estudiará en el presente trabajo la idoneidad y utilidad de estos resultados, reflejando estudios que se han hecho sobre los mismos. Todo esto con una finalidad concreta, ya que el trabajo tiene una cuarta parte: La reincidencia. Es por ello que, una vez estudiadas estas tres perspectivas, se pasa a analizar los porcentajes de reincidencia de este tipo de delitos, si los tratamientos efectuados sobre los presos son válidos para reducir la misma o si podríamos fomentar el uso de predictores de riesgo de reincidencia en España, en el caso de que éstos fueran verdaderamente útiles. ; In the present work, an analysis of the sexual assault crime has been carried out from three different perspectives, in order to know everything related to it and perform a final study. It is for this reason that, firstly, an analysis on the criminal regulation of this offence, as well as its variants and all the assumptions that could take place, will be carried out; secondly, the parties involved in the crime, both the victim and the sexual aggressor, will be analysed too.
