عقوبة تهريب السلع والعملة الأجنبية دراسة مقارنة في فقه المذاهب والقانون الوضعي الايراني ; Comparative study of the punishment of contraband of goods and currency in jurisprudences and Iranian Law

يعدّ التهريب بمفهومه القانونیّ ضرباً من الأعمال المصطبغة بالغش في عصرنا الحديث الذي يمتّ إلى أمور مثل الجمارك والإستي ا رد والتصدير بصلة متينة ويتحقّق بخرق الإج ا رءات القانونيّة المتعلّقة باستي ا رد العملات وتصديرها ويبعث في كيان النظام الاقتصادي صدمات معمّقة لاتخفى على الأخصائين في هذا المجال. اختلفت العقوبات المتعلّقة بهذا اللون من الج ا رئم باختلاف قوانين التهريب على مرّ التاريخ وبمقدار ما للموضوع من أهمية في مختلف الظروف والأحوال لدىكل مجتمع من المجتمعات، وعلى نفس المنوال حدَّد القانون ; The crime of contraband in its legal definition is in fact a modern deceitfully operation which is in correlation with subjects such as customs, imports and exports and happens when legal protocols regarding imports ans exports are breached and the deep damages caused by them in the society are apparent to the experts. By looking at the history and evolution of laws and by the importance of the subject in different situuations and lastly in new laws, different penalties is considered for this crime; the most important ones are: seizure of goods, pecuniary penalty, and destruction of the goods, imprisonment, and lashing. By comparative studing this kind of penalties with jurisprudence there seem to be a semblance between the law and jurusprudence’ this semblance can be categorized in three categories: the criminal laws regarding ta’azir, Osooli, jurisprudence principles and fatwahs regarding contraband of goods and currency.
