العدالة الانتقالية لم تعرف إلا مع تجارب الانتقال الديمقراطي للدول التي تمر بمراحل انتقالية بعد ثورات أو نزاعات مسلحة التي من ضمنها دول الربيع العربي ومنها دولة ليبيا، وقد قمنا في هذه الدراسة بتسليط الضوء على موضوع دسترة العدالة الانتقالية وأهمية النص عليها في صلب الدستور، وهل تعتبر من الموضوعات الدستورية التي يجب أن يحتويها الدستور؟ قد قمنا بتقسيم هذه الدراسة إلى أربعة مطالب حاولنا من خلالها تسليط الضوء على العدالة الانتقالية من حيث مفهومها اللُّغوي والاصطلاحي، وكذلك بيّنا مفهوم الدسترة وموقف المشرع اللِّيبي من برنامج العدالة الانتقالية منذ تأسيس الدولة عام 1951م إلى وقتنا الحالي، وبينّا أيضا في مطلب مستقل آراء المؤيِّدين والعارضين لفكرة دسترة العدالة الانتقالية وتضمينها في نصوص الدستور القادم، وفي النهاية وَصلنا إلى بعض الاستنتاجات والتوصِيات التي تم عرضها في خاتمة البحث ; Transitional justice has not been known except with the experiences of democratic transition of countries going through transitional stages after revolutions or armed conflicts, including the Arab Spring countries, including the State of Libya. Of the constitutional issues that should be in the constitution? We have divided this study into four demands through which we tried to shed light on transitional justice in terms of its linguistic and reformist concept, as well as the concept of constitution and the position of the Libyan legislator on the transitional justice program since the establishment of the state in 1951 AD to the present time, and we also indicated in an independent demand the opinions of supporters and opponents To the idea of constitutionalizing transitional justice and including it in the texts of the next constitution, and in the end we reached some conclusions and recommendations that were presented in the conclusion of the research.
