نبذة مختصرة : Discursos sobre a necessidade de defesa e efetividade dos direitos humanos são recorrentes e não há dúvida quanto à centralidade desses direitos. O grande debate na Filosofia do Direito Internacional envolve, geralmente, a definição do seu rol, bem como as hipóteses nas quais se configuram violações. Diante desse quadro, foi realizada pesquisa teórica com o escopo de investigar algumas das principais definições de direitos humanos, a fim de, ao final, demonstrar que a teoria de Dworkin é, atualmente, a mais adequada para a efetividade dos direitos humanos e, especialmente, para explicar e defender a proibição absoluta do uso de mecanismos de tortura. O presente artigo irá aplicar esse conceito dworkiniano de direitos humanos, qual seja, direitos que atuam como trunfos contra as justificativas para ação política, à prática da tortura, demonstrando que configura uma grave violação de direitos humanos. Para tanto, utiliza-se como técnica metodológica a pesquisa teórica e jurisprudencial e o procedimento metodológico de análise de conteúdo.
