نبذة مختصرة : In all times marriage institution was, still is and will be one of the most important social and legal norms. Description of the marriage institution was changed in the course of history, depending on this time culture, relationship of the Church and the State and general outlook of the society. Marriage is very important part of family creation. It is a legal family base and condition for marriage legalization. For marriage legal registration, it must satisfy requirements, which are set according to laws. In Europe countries and USA those requirements are similar, but in the respect of time its are constantly changing. It especially is noticeable from the perspectives of human rights development. In many countries marriage is named as civil agreement, which is confirmed in state empowered institutions and it with some restrictions (age, monogamy, free will, relationship) is concluded between two different genders people. The main requirement for valid marriage is different sex of the spouses, which long time without exceptions was characteristic for all countries. The Church and State has the same position into the different sex as one of the main requirement for valid marriage. If we looked round the historical times we can assume, that this position existed during all ages. It can be also mentioned that long time those requirements for valid marriage was set by Church and it’s difficult to explain, which requirements for valid marriage the State took from Church and on the contrary. But It’s quite clear , that requirement of different spouses sex still is and will be as a main condition for valid marriage. Lithuanian laws and also church position to samesex marriage is the same: they both prohibit this type of marriage. [.]
