O papel da comissão técnica de classificação na execução penal: viabilidade de implantação da CTC na casa de prisão provisória de Palmas/TO

This thesis aims to propose to the State of Tocantins the creation and regulation of Classification Technical Committee in Provisional Prison House of the District of Palmas / TO, as an initial model for other state prisons, in order to apply the individualising program for those convicted to imprisonment and pre-trial detainees. The competence of the CTC in its legitimating design, discusses the ongoing assessments, undertaken by interdisciplinary teams: psychiatrists, psychologists, social workers, secretary, foremen, production manager, legal representative, internal security representative, being presided over by the the prison unit, as re-educating the profile, in order to give more technical and scientific support to the magistrate in the uniqueness of criminal enforcement in accordance with the legal provisions of the penal execution Law, the penal Code, both in accordance with the Federal Constitution 1988 on the convict's behavior, since it relates intrinsically with the objective merit of the imprisoned. It analyzes the importance of individualization of punishment in the democratic rule of law, discusses the differences between the proceedings for review of subjective elements to the granting of benefits their imprisonment: criminological examination, personality examination and opinion of the Classification Technical Committee. The study, to climb your goal, summarizes the legal, logistical and financial framework needed to the proposal embodied in the initiative of the Bill by the President of the State of Tocantins Court. ; A presente dissertação tem como objetivo propor ao Estado do Tocantins a criação e regulamentação da Comissão Técnica de Classificação na Casa de Prisão Provisória da Comarca de Palmas/TO, como modelo inicial para as demais unidades prisionais estaduais, com o fim de aplicar o programa individualizador para os condenados às penas privativas de liberdade e aos presos provisórios.
