URGENSI KRIMINALISASI TERHADAP PERBUATAN KOHABITASI (SAMEN LEVEN) SEBAGAI DELIK ADUAN DALAM KETENTUAN UNDANG-UNDANG NOMOR 1 TAHUN 2023 TENTANG KITAB UNDANG-UNDANG HUKUM PIDANA

Cohabitation is regulated (samen leven) as a criminal offence in the provisions of Law Number 1 of 2023 on the Criminal Code has drawn pros and cons from Indonesian society. Cohabitation is an act that is not in accordance with the values that live and develop in Indonesia as a country with an eastern style. Moreover, cohabitation is considered a criminogenic act. This research aims to determine the basis for consideration of the need to criminalize cohabitation (samen leven) in the provisions of Law Number 1 of 2023 on the Criminal Code and the effectiveness of the application of the offence of complaints against acts of cohabitation (samen leven) in the provisions of Law Number 1 of 2023 on the Criminal Code.This research uses a normative juridical type of research with descriptive analysis based on legal statute approach, case approach and conceptual approach. The data collection techniques used were literature review and interview.This research shows that the act of cohabitation is a deviant and is contrary to the values and norms prevailing in society. The government's efforts to criminalise the act of cohabitation (samen leven) is a progressive step in ensuring the welfare of society and social defence through a criminal policy and criminal law policy.
