Feminicidio en Colombia, violencias contra la mujer: posibilidades desde la jurisprudencia y el derecho penal ; FEMINICIDE IN COLOMBIA, VIOLENCE AGAINST WOMEN: POSSIBILITIES FROM JURISPRUDENCE AND CRIMINAL LAW

Este documento pretende ser un llamado a partir de la investigación y el estudio de análisis de situación con referencia a las múltiples formas de violencia contra la mujer, el homicidio tipificado como Feminicidio, acercándose al reconocimiento de la jurisprudencia colombiana y el actuar desde el “derecho penal” frente a las violaciones y vulneraciones de la mujer. Inicialmente se expone la concepción de las problemáticas que afronta la mujer en una óptica cultural, tradicional, social y política, para entrar a definir el Feminicidio, sus posibles razones o causas, las cuales se examinan desde la óptica de las violencias de género y las manifestaciones de estas hacia la mujer; se contempla la necesidad y posibilidad de robustecer la política gubernamental en diálogo vinculante con la legislatura y el derecho penal. Resalta la oportunidad de situar las complejidades en la vulneración de derechos hacia la mujer, la ausencia, manipulación y politización poco asertiva de la lucha femenina. ; Universidad Libre- Facultad de Derecho-Especializacion Derecho Penal y Criminologia ; This document intends to be a call from the investigation and the study of situation analysis with reference to the multiple forms of violence against women, the homicide typified as Femicide, approaching the recognition of Colombian jurisprudence and acting from criminal law against the violations and infringements of women. Initially, the conception of the problems that women face from a cultural, traditional, social and political perspective is exposed, in order to define Feminicide, its possible reasons or causes, which are examined from the perspective of gender violence and the manifestations of these towards women; the need and possibility of strengthening government policy in a binding dialogue with the legislature and criminal law is contemplated.
