Crime e punição: um enfoque no desenvolvimento das capacidades humanas

Everyone has the right to basic and quality education, to health, to safe and nutritious food, to work that is synonymous with the progress of the citizen and to full socialization, to housing that is a mechanism of physical and moral protection and to security, as guaranteed by the Federal Constitution of 1988. Today many people in the world suffer from the deprivation of basic survival needs. Deprivation of the development of individual capacities of human beings, according to Sen (2000), may be strongly related to the lack of quality of life and access to income, work and education that gives him freedom to express himself and to develop as a citizen. From these assumptions, this paper dialogues about crime and punishment, seeking to demonstrate the rationality of a person to commit a crime, especially the lucrative crime. Punishment could come in conjunction with appropriate reeducation and resocialization. That is, helping the individual to focus his skills and develop his talents for the good of society at large and for himself. It is assumed that every human being is a capable being who has skills to develop and is beneficial to the community. Through the bibliographical, descriptive, explanatory, explanatory and field research methodology, an analysis was made of the socioeconomic profile of persons deprived of their liberty in Brazil and Tocantins, and an analysis of persons deprived of liberty in labor and educational activities in the Tocantins Penitentiary System from 2012 to 2017, with a focus on 2017.
