      Il saggio studia il rapporto fra mediazione notarile e autonomia dei privati nella redazione e nella gestione archivistica delle scritture relative al credito a Bergamo, tra metà Duecento e metà Trecento, con riferimento all’amministrazione contabile dei patrimoni e alla certificazione degli obblighi reciproci. Quanto al primo aspetto l’intervento dei notai, ancora frequente nella stesura di inventari e registri contabili nella seconda metà del Duecento, fu superata, a inizio Trecento, dalla tenuta autonoma di memorialia concepiti per una lunga durata. Sul fronte della rilevanza giuridica, nonostante alcuni esperimenti compiuti in tal senso, le scritture private e i libri di conto non acquisirono invece, diversamente da altre aree del nord Italia, un valore probatorio simile a quello dell’instrumentum notarile, che rimase uno strumento imprescindibile per l’accensione e il trasferimento di rapporti creditizi. ; The essay studies the relationship between notarial mediation and the autonomy of businessmen in the writing and archival management of credit records in Bergamo, between the mid-thirteenth and mid-fourteenth centuries, with reference to accounting administration and the certification of obligations. With regard to the first aspect, the intervention of notaries, still frequent in the drafting of inventories and accounting registers in the second half of the 13th century, was superseded, at the beginning of the 14th century, by the autonomous keeping of memorialia conceived for a long duration. On the other hand, unlike in other areas of northern Italy, account books and private records did not acquire an evidentiary value similar to that of the instrumentum, which remained an indispensable means for the establishment and transfer of credit relationships.
