O status jurídico dos animais não-humanos : análise do direito brasileiro e perspectivas futuras

O presente trabalho pretende analisar as controvérsias existentes quanto a conceituação dos animais perante o direito. Para tanto, será realizada, primeiro, análise dos regulamentos que disciplinam a temática no direito brasileiro. Após, passar-se-à ao exame de julgados que demonstram o entendimento dos Tribunais Superiores brasileiros quanto à temática, e, por fim, as principais perspectivas para o tratamento futuro da questão serão expostas a partir das correntes de bem-estar animal e de direitos dos animais. ; The following paper aims to analise the existing controversies on the concept of animals before the law. Therefore, first, an analysis of the institutes that regulate the theme in Brazilian Law will be undertaken. Afterwards, decisions that demonstrate Brazillian’s Supreme Courts understanding on the matter will be examined, and, lastly, the main perspectives for the future treatment of the issue will be presented, passing through the welfarism and animal’s rights approaches.
