      Entry to the public service is limited for people with an enforceable conviction. Its requirements and prohibitions established in art. 10 of the Organic Law of Public Service (LOSEP), and Art. 3 numeral 1, literal b, of the Regulations to the LOSEP, do not allow people who have been convicted of exercising a position, function, position, or public dignity. For this reason, in the present investigation is considered the analysis of the incidence of the judicial past in the entrance to the public service. Based on the Republic of Ecuador's Constitution, discrimination is prohibited by an individual's judicial past. Then when requesting a certificate of not having legal impediment to entering the public service and that contains that it has not had problems with the justice for various crimes falls directly on the violation of the principle of not discrimination. Thus, apart from being an unconstitutional requirement for going against the regulations supreme, the right to work, equality, a decent life, and the right to participate is restricted from the legal point of view. We find ourselves in a society where the State itself does not protect its citizens' rights; therefore, the facts mentioned above allow us to point out that there is a violation of constitutional principles and rights in reality.
