نبذة مختصرة : Discrimination based on sex or gender in the workplace is a problem that affects most of the States where women, as well as the LGBTI community, are historically excluded groups, due to phallocratic thinking that has normalized behaviors that undermine the right to formal and material equality, creating preconceived ideologies that are transferred from generation to generation. The present study aimed to analyze the factors that influence wage discrimination and access to the labor market by gender condition, for which a bibliographic, exploratory and descriptive review of the scientific literature reported in scientific and academic databases such as: Dialnet, Scopus, Web of Sciences, Redalyc, ErihPlus, DOAJ, Scielo and Google Scholar, as well as the study of the national legal framework and International Instruments related to the research problem. In addition, the analytical-synthetic method was applied for the analysis of the results, where labor segregation has been identified as multifactorial. Likewise, it was found that the legal regime that protects women's rights has advanced at a dizzying pace. However, at present, the procedures and policies in force in Ecuador have not been sufficient to prevent exclusion from promotion and election in the workplace. ; La discriminación laboral por sexo o género es un problema que afecta a la mayoría de los Estados donde la mujer, así como, el colectivo LGBTI son grupos históricamente excluidos, debido a pensamientos falócratas que han normalizado conductas que menoscaban el derecho a la igualdad formal y material creando ideologías preconcebidas que se transfieren de generación en generación.
