İfade özgürlüğü ve avrupa birliği medya politikasına uyum çerçevesinde televizyon programlarının sınıflandırılması sorunu

Social, cultural, economic and political developments in human life have been source of inspiration for broadcasters to produce new programme types. In addition, thanks to the rapidly tecnological development it has been inevitable to describe the programs again and manifest the differences between varieties and sub-varities clearly on behalf of supervising the appropriateness of the radio and television broadcasts to law.The supreme boards that serve as a regulatory authority in the field of television broadcasting, feel the need for having an agreement with broadcasting institutions in a common language by supervising television programs in respect of the suitability to law. This situation has become an obligation over time; andı t has become inevitable to develop common broadcasting standards.In Chapter One of the study, by mentianing the describtion and history of the television, the development of the television broadcasting in Turkey has been handled; in the second Chapter, with reference to the concept of freedom of speech, it has been explained how the freedom of speech is treated in the national manifestos and documents, have been explained. In the third Chapter, by dwelling upon the freedom of program arrangement which the freedom of speech provides the television program broadcaster, the reasons which drive the broadcasters in to the freedom of program arrangement have been discussed. In the fourth Chapter, the studies which EBU and RTÜK have prepared for the classification and coding of television programs, have been evaluated, criticized and alternatively a new classifying and coding guide has been prepared.In this study, the orijinal text of the ?Classification System of he Radio and Television Programs? prepared by EBU has been translated in to Turkish and studied. It is aimed to answer the actual problems by means of the alternative guide prepared in this field to complete the missing aspects of the booklet ?The Program Types in Broadcasts, Coder, Definitions and Classifications? which EBU prepared, being inspired from this study. İnsan yaşamındaki sosyal, kültürel, ekonomik ve siyasal gelişmeler televizyon yayıncılarının yeni program türleri ortaya koymasına esin kaynağı olmaktadır. Teknolojinin de hızla gelişmesi sayesinde program tanımlarını yeniden yapmak, türlerin ve alt türlerin ayrımını net ifadelerle ortaya koymak, radyo ve televizyon yayınlarının hukuka uygunluğunu denetlemek adına kaçınılmaz olmuştur.Televizyon yayıncılığı alanında düzenleyici ve denetleyici otorite olarak görev yapan üst kurullar, televizyon programlarının hukuka uygunluğunu denetlerken, yayın kuruluşları ile ortak bir dilde anlaşma ihtiyacı hissetmektedir. Bu durum zaman içerisinde bir zorunluluk halini almış ve ortak yayın ölçütlerinin geliştirilmesi kaçınılmaz olmuştur.Çalışmanın ilk bölümünde televizyonun tanımı ve tarihçesine değinilerek, Türkiye'de televizyon yayıncılığının gelişimine; ikinci bölümde, ifade özgürlüğü kavramı ele alınarak ulusal bildiri ve belgelerde ifade hürriyetinin nasıl ele alındığı açıklanmıştır. Üçüncü bölümde, ifade özgürlüğünün televizyon program yayıncısına sağladığı program düzenleme serbestliği üzerinde durularak, yayıncıları program düzenleme serbestliğine sevk eden sebepler tartışılmıştır. Dördüncü bölümde ise, televizyon programlarının sınıflanması ve kodlanmasına yönelik EBU'nun ve RTÜK'ün hazırladığı çalışmalar değerlendirilmiş, eleştirilmiş ve alternatif yeni bir sınıflama ve kodlama kılavuzu hazırlanmıştır.Bu çalışmada, EBU'nun hazırladığı ?Radyo-Televizyon Programlarını Sınıflandırma Sistemi? çalışmasının orijinal metni Türkçe'ye çevrilerek sınıflandırma ve kodlama bilgileri incelenmiştir. RTÜK'ün bu çalışmadan esinlenerek hazırladığı ?Yayınlarda Program Türleri Kod, Tanım ve Sınıflandırmaları? Kitapçığı'nın eksik yönlerinin tamamlanmasıyla oluşturulan alternatif kılavuzun alanda yaşanan güncel sorunlara cevap vermesi hedeflenmektedir.
