Uma leitura hermenêutica das características do neoconstitucionalismo

O presente artigo traz uma introducao, descricao e critica do neoconstitucionalismo, entendido este como o movimento que procura, a partir das constituicoes estabelecidas apos o segundo pos-guerra, reaproximar direito e moral, oferecendo uma resposta ao fracasso do positivismo. Sendo assim, pretendo primeiro me distanciar deste movimento; apos, mostrar as diversas falhas na sua critica muito simplificada ao positivismo e realizando; e, por fim, fazer uma nova leitura sobre este fenomeno, a partir de uma visao hermeneutica. ABSTRACT : The present paper brings an introduction, description and critique of the new constitutionalism, understood as a movement that based on post-WWII constitutions wishes to reconcile law and morality, offering an answer against positivism’s failure. In this sense, I intend to distance myself from this movement and then show the failure of its followers on their critique of positivism. In the end, I intend to provide a new reading on this phenomenon, after a hermeneutical point of view.
