      An essay is presented which determines reasons behind the racial discrimination in death penalty cases. It depicts that systematic exclusion of death-qualified African American jurors decreases jury accuracy and legitimacy of legal system. It reflects that the seminal work of David Baldus, Joseph B. Tye professor of law at the University of Iowa, on racial unfairness in the U.S. Supreme Court case McCleskey v. Kemp resulted in the development of the North Carolina's Racial Justice Act.
