The article focuses on the No Child Left Behind Act (NCLB) and the provisions of the bill, Titles I and III, that pertain to Limited English Proficient (LEP) children. By the year 2013 all children including economically disadvantaged, those from major racial and ethnic groups, those with disabilities, and those with LEP must achieve an equal proficiency level on academic standards. The flaw in the NCLB is that it fails to recognize that LEP children can never be at the state's proficient level, even if every child later becomes a high-achieving English speaker. The article presents topics such as measurable objectives and Local Education Authorities, identifying LEP children, redesignation, alternative tests, and attaining English proficiency tests.
