Public support and photovoltaic solar energy through Law number 14.300 of 2022. (English)

It is given to the Public Administration the possibility to interfere in Economics through direct ways and also indirectly, being public support one of the possible ways of intervention. Public support can be developed through many different ways, such as tax incentives, public funding and subventions for example. When it comes to Photovoltaic Solar Energy, it is noticeable a great interest in supporting its implementation by private initiative and in such context there are some public policies that stand out. In this context, the present study aims to describe Law number 14.300/2022, as distributed microgeneration and minigeration's legal framework, in order to verify its potential innovation measures in terms of public support when it comes to photovoltaic solar energy and also its possible modifications towards public support measures that already exist. For these purposes, the method used will be the deductive, with qualitative approach, through bibliography and documental research. [ABSTRACT FROM AUTHOR]

A Administração Pública é autorizada a interferir na economia, de forma direta e indireta, sendo uma das possíveis formas de intervenção o fomento público. Essa interferência pode ser ocorrer de diversas maneiras, por meio de incentivos fiscais, financiamentos, subvenções, entre outros. Quanto à energia solar fotovoltaica, verifica-se um grande interesse e relevância em incentivar sua instalação pela iniciativa privada, destacando-se algumas políticas públicas adotadas para tanto. Nesse contexto, o presente estudo tem como objetivo analisar a Lei n.° 14.300/2022 enquanto marco legal da micro e minigeração distribuída, a fim de verificar as eventuais inovações em medidas de fomento público quanto à referida fonte energética e as possíveis alterações quanto às formas de fomento já existentes. Para tanto, é utilizado o método dedutivo com abordagem qualitativa, a partir de pesquisa bibliográfica e documental. [ABSTRACT FROM AUTHOR]
