The Punishment for Insulting the Companions.

The Companions are the first generation of Muslims who met the Prophet, believed in him and made friends with him. Companions have greatly contributed to the transportation of Islam to the next generations. For this reason, Muslims generally commemorate the first generation of Islam, the Companions. However, from time to time, we witness that the Companions were insulted. The punishment for insulting the Companions is the subject of this article. The continuation of insulting the Companions, as in the past, makes it important to address this issue. In this study, it was seen that different punishments such as beating, imprisonment and death were appreciated by the Islamic jurists for those who insulted the Companions. Based on the fact that different punishments are foreseen for insulting the Companions in Islamic law, it has been concluded that the discretion of the punishment is left to the state. Sahâbe, Hz. Peygamber’e mülaki olmuş, ona iman etmiş ve ona arkadaşlık etmiş ilk Müslüman neslidir. İslâm’ın sonraki nesillere ulaştırılmasında sahâbenin büyük katkısı vardır. Bu nedenle Müslümanların geneli İslam’ın ilk nesli olan sahâbeyi hayırla anarlar. Bununla birlikte zaman zaman sahâbeye dil uzatıldığına şahit olmaktayız. Sahâbeye hakaretin cezası bu makalenin konusunu teşkil etmektedir. Sahâbeye hakaretin geçmişte olduğu gibi günümüzde de devam etmesi bu konuyu ele almayı önemli kılmaktadır. Makalede ilk olarak sahâbenin tanımına, sebb ve şetm kavramlarına, sahâbeye hakaretin haram oluşuna yer verildi. Daha sonra sahâbeye hakaretin kişinin küfrünü gerektirip gerektirmediği meselesi ele alındı. Son olarak da sahâbeye hakaretin cezası ile Hz. Âişe’ye ve Hz. Peygamber’in diğer eşlerine hakaretin cezası incelendi. Bu çalışma ile İslâm hukukçuları tarafından sahâbeye hakaret edene dayak, hapis, ölüm gibi farklı cezaların takdir edildiği görülmüştür. İslâm hukukunda sahâbeye hakaret eden için farklı cezaların öngörülmüş olmasından hareketle cezanın takdir yetkisinin devlete bırakıldığı sonucuna ulaşılmıştır. [ABSTRACT FROM AUTHOR]
