The Impact of Maqasid Consideration on Human Rights.

The topic of this research came under the title (The Impact of Maqasid Consideration on Human Rights), it consist of an introduction, a preface, and four chapters. The preface: it included the definition of the terms mentioned in the title of the search. The first chapter: the historical context of the Maqasid consideration of human rights. The second chapter: the impact of the Maqasid consideration of the right to religion. The third chapter: the impact of Maqasid consideration of the right to equality. The fourth chapter: the impact of the Maqasid consideration of the right to freedom. The research aims to: demonstrate the impact of the Maqasid on human rights, explaining that the rights of Allah and the rights of the people are intertwined, and to uncover the deficiencies in the contemporary Maqasid consideration and its position on human rights. Among the most important findings of the research are: The Maqasid scholars were among the first to talk about rights in its Maqasid context. The true religion is the greatest of Allah’s rights, and true religion is the greatest of human right. The rights of Allah and the rights of the servants are not separated in the Maqasid perception. جاء موضوع هذا البحث بعنوان )أثر النظر المقاصدي في حقوق اإلنسان(، ويشتمل على مقدمة وتمهيد وأربعة مباحث، التمهيد: وفيه التعريف بالمصطلحات الواردة في عنوان البحث. المبحث األول: في السياق التاريخي للنظر المقاصدي حول حقوق ّن. المبحث الثالث: ّة. ويهدف البحث إلى: بيان أثر المقاصد في حقوق اإلنسان، وتقرير ّ في أثر النظر المقاصدي في حق المساواة. المبحث الرابع: في أثر النظر المقاصدي ّ اإلنسان. المبحث الثاني: في أثر النظر المقاصدي في حق ّ التدي تالزم حقوق اهلل وحقوق العباد، والكشف عن جوانب القصور في النظر المقاصدي ّ في حق الحري المعاصر وموقفه من حقوق اإلنسان. ويقوم منهج البحث على المنهج االستقرائي البحث:علماء المقاصد من أوائل من تحدث عن الحقوق في سياقها المقاصدي. الدين ّ التحليلي، والرجوع للمصادر األصلية، وااللتزام بقواعد البحث العلمي. ومن أهم نتائج ّن الصحيح هو أعظم حقوق اإلنسان. حقوق اهلل, الحق هو أعظم حقوق اهلل, والتدي وحقوق العباد ال تنفصل في التصور المقاصدي. المساواة في الشريعة أصل ال يتخلف ّة. ّ ّ ة مقصد مكمل للمقاصد الضرورية. رفض التوسع في تفسير الحري إال لمانع. الحري وأبرز توصيات البحث: رصد التوظيفات المعاصرة للنظر المقاصدي من الموضوعات ّة بحقوق اإلنسان يتطلب الجديرة باهتمام الباحثين. التأصيل لعالقة المقاصد الشرعي مزيدا من البحث. التفسير المقاصدي لعالقة حقوق اهلل بحقوق اإلنسان ال يزال بحاجة لدراسات جادة.
