The right to health and the role of law during epidemics -covid epidemic 19 a as -model.

إن اآلثار الظاهرة التي خلفها ويخلفها وباء كورونا المستجد منذ مطلع العام الحالي، ومخاطره األخرى غير المعروفة، تؤدي إلى قدر كبير من عدم اليقين بشأن تقييم األوضاع، وصعوبة في صنع القرارات الصائبة للتقليل من سرعة انتشار الوباء ومكافحته، تضع العلم والسياسة والقانون في محك التجربة واالختبار. فبينما يتسمك علماء الطب بآرائهم ويضعون مصداقية المعرفة الطبية محل التساؤل، يواجه السياسيون خطر االتهام باإلهمال أو اإلفراط، ويدعو القانونيون إلى حماية الحق في الصحة، مع ضرورة احترام القانون، وربط أي تدابير تتخذ بشرط الضرورة والتناسب، خوفا من المساس الجائر بالحقوق والحريات األخرى. واستناد إلى ما ذكر، فإن هذه الدراسة مستعينة بالمنهجين االستقرائي والتحليلي تركز على النظرة القانونية إلى األزمة الناجمة عن الوباء المذكور، وهي مقصورة على التعرف على مكانة الحق في الصحة في المعايير القانونية الدولية والوطنية، وما تفرزه من التزامات، وعلى تتبع مدى كفاية التشريعات السارية ومرونتها في التعامل مع مخاطر األزمة الصحية التي تسببها األوبئة، وبالخصوص وباء كورنا المستجد )كوفيد 19. The effects of the emerging Corona epidemic since the beginning of this year, lead to a very high uncertainty, and a great difficulty in making the right decisions to reduce the speed of the epidemic and to combat it. This difficulty puts science, politics, and law under test. While scientists putting the credibility of medical knowledge in question, politicians face the danger of being accused of negligence or excess, and legal advocates call for the protection of the right to health, by taking into account the respect the law, and link any measures taken on the condition of necessity and proportion, since they fear of unfair prejudice to other freedoms. According to the aforementioned, this study focus on the legal view of the crisis caused by the said epidemic, and it is limited to identifying the place of the right to health in international and national legal standards, and to tracking the adequacy and flexibility of the applicable legislation in dealing with the dangers of the health crisis caused by the epidemics, especially the new corona epidemic.
