العالقة بني احلـــــاكم واحملكوم يف الشريعة اإلسالمية .

Praise be to Allah and peace and blessings be upon the Messenger of God, his family and peace And after It is well known that the law that was revealed to the Prophet Muhammad, peace be upon him had come to explain the ruling of God in all aspects of life, religious and worldly, and the work of the Prophet, peace be upon him to guard the religion and state policy, so like those who succeed him and his deputy, Caliphate on behalf of the Prophet him in the custody of religion and politics parish and state-building, and is obliged to preserve the religion and walk in its mundane to clear guidance is indicated by Sharia, and that there are rules and established the legitimacy of governing the relationship between the parish on the one hand and the ruling on the other hand, came to research this (the relationship between the ruler and the ruled in Islamic law) to shed light on this important aspect of Islamic legislation, and includes a search four demands and a conclusion which showed the most important findings, and these demands are: first requirement: Caliph definition of second requirement: must governor's inauguration, the third requirement: the relationship between the ruling and the ruled, the fourth requirement: rule out the ruling.That I was of the reconciling God to me but missed it myself and Satan God and ask forgiveness for any failure may Badr me and thank God and prayed God to the prophet Muhammad and his family and him. الحمد هلل والصالة والسالم على رسول هللا وعلى آله وصحبه وسلم وبعد: فمن المعلوم أن الشريعة المنزلة على سيدنا محمد  قد جاءت ً، وعمل النبي لبيان حكم هللا في كافة نواحي الحياة دينيا  على حراسة الدين وسياسة الدولة، فكذلك الحال فيمن يخلفه وينوب عنه، ً ودنيويا فالخالفة نيابة عن النبي  في حراسة الدين وسياسة الر عية وبناء الدولة، وهي ملزمة بالحفاظ على الدين والسير في سياستها الدنيوية على الهدي الواضح الذي بينته الشريعة الغ ارء، وأن هناك قواعد وأسس شرعية تنظم العالقة بين الرعية من جهة والحاكم من جهة أخرى، فجاء بحثي هذا ) العالقة بين الحاكم والمحكوم في الشريعة اإلسالمية( ليسلط الضوء على هذا الجانب المهم من جوانب التشريع اإلسالمي، ويتضمن البحث أربعة مطالب وخاتمة بينت فيه أهم النتائج التي توصلت إليها، وهذه المطالب هي: المطلب األول: تعريف الخليفة والمطلب الثاني: وجوب تنصيب الحاكم، والمطلب الثالث: العالقة بين الحاكم والمحكوم، والمطلب الرابع: حكم الخروج على الحاكم.فإن أصبت فهذا من توفيق هللا لي وإن أخطأت فمن نفسي والشيطان واستغفر هللا على أي تقصير قد بدر مني والحمد هلل رب العالمين وصلى هللا على سيدنا محمد وعلى آله وصحبه وسلم.
